Terms of Service

These Terms of Service ("Terms") are an agreement between you and Martin Property Development, LLC, doing business as Arkansas Compliance Safe ("ACS," "we," "us") and govern your use of the ACS mobile app and arpermitsafe.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you're using ACS for a business, you agree on behalf of that business and confirm you have authority to do so.

1. Who can use ACS

You must be at least 18 years old and able to enter a binding contract. You're responsible for everyone you give access to under your account, including staff you add, and for keeping your login secure.

2. Subscriptions and billing

• Plans: ACS offers Training Essentials and ACS Pro plans, priced per location. Current prices are listed on arpermitsafe.com and in the app.
• Training Essentials is billed annually only.
• ACS Pro is billed monthly or annually.
• Purchases through app stores: subscriptions bought in the app are billed by Apple or Google under their terms. Payment is charged to your app store account.
• Automatic renewal: subscriptions renew automatically at the end of each billing period unless you turn off auto-renew at least 24 hours before the period ends.
• Cancellation: cancel anytime in your App Store or Google Play subscription settings. Cancellation stops the next renewal; you keep access through the end of the current paid period.
• Refunds: refunds for app store purchases are handled by Apple or Google under their policies. We don't provide partial refunds for unused time.
• Price changes: we may change prices with advance notice. Changes apply at your next renewal, and you can cancel before then.

3. The AI rulebook

• AI rulebook answers are generated by artificial intelligence and can be incomplete, outdated, or wrong.
• Answers are for general information only. They are not legal advice and are not an official interpretation by ABC, ATC, or any agency.
• Always check the cited rule. For a binding answer about your situation, contact the appropriate agency or an attorney.
• The AI rulebook uses a third-party AI provider and only works after you give permission, as described in our Privacy Policy.

4. Training and certificates

Certificates issued through ACS are records that a person completed ACS training. They are not a state-issued license, permit, or certification, and completing ACS training does not guarantee compliance or protect you from enforcement action.

5. Law change alerts and content accuracy

We work to keep rules, forms, ordinances, and alerts current, but laws change and we can't guarantee that every change is reflected immediately or at all. Don't rely on ACS as your only source for legal requirements.

6. Your content

You own the records, documents, photos, and other content you put into ACS ("Your Content"). You give us permission to store, process, and display Your Content only as needed to provide the Service to you. You're responsible for having the right to upload Your Content, including information about your employees.

7. Forum rules

When you post in the permit holder forum, don't:

• Post anything illegal, threatening, harassing, or defamatory.
• Share other people's personal information without permission.
• Advertise, spam, or impersonate anyone, including a government agency or official.
• Post content you don't have the right to share.

We may remove posts and suspend accounts that break these rules. Forum posts reflect the views of the people who write them, not ACS.

8. Acceptable use

Don't misuse the Service. For example, don't try to access other users' accounts or data, reverse engineer or copy the app, overload or disrupt our systems, or use ACS for any unlawful purpose.

9. Third-party services

ACS may link to or recommend third-party products, such as ID scanning providers. We don't control them, and your use of them is governed by their own terms. ACS is not affiliated with these companies unless we say so.

10. Termination

You can stop using ACS and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the Service. If we discontinue the Service, we'll give you reasonable notice and a chance to export your records.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee the Service will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent allowed by law, ACS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for fines, penalties, permit suspensions or revocations, or lost profits, arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnity

You agree to defend and hold ACS harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or the law.

14. Governing law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Washington County, Arkansas, and you consent to their jurisdiction.

15. Changes to these Terms

If we make material changes, we'll update the effective date above and notify you in the app or by email before the changes take effect. Continuing to use ACS after that means you accept the updated Terms.

16. Apple-specific terms

If you downloaded ACS from the Apple App Store: these Terms are between you and ACS, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any product claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
